Last month, EPA got into hot water when it spilled 3 million gallons of heavily polluted water from an abandoned mine into the popular Animas River in Colorado—causing it to flow bright orange for several days. The agency’s response to this colossal disaster was an underwhelming “Oops! Sorry.”
EPA’s not so forgiving when it comes to private property owners that run afoul of its commands. Take Andy Johnson, for instance. He’s a small property owner from Wyoming, who created a pond on his 8-acre property to provide water for his livestock.
I n stark contrast to EPA’s massive spill, Andy’s activities benefit the environment. Wetlands and riparian vegetation sprang up around it. It provides scarce rich habitat for fish and an important water source for wildlife, including bald eagles. If that wasn’t enough, the pond also purifies water that passes through it, by removing sediment and other pollutants. It’s a true win-win; the pond serves Andy’s livestock and improves the environment.

We believe Federal District Court Judge David Bunning grossly overstepped his bounds and violated Mrs Davis’ due process rights, and in particular her right to a jury trial. This judge has assumed unto himself not just the powers of all three branches of government, but has also taken on the powers of judge, jury, and “executioner.” What matters to us is not whether you agree with her position on gay marriage or her decision to not issue marriage licenses. What matters is that the judge is violating the Constitution in his anger and desire to punish her for going against his will. We are already being subjected to an unconstitutional imperial presidency, that grew exponentially under both Bush and Obama, expanding the claimed war powers of the president to swallow up our Bill of Rights and circumvent jury trial. The result is an executive branch that claims the absurd power to declare any American an “unlawful combatant” on the say-so of the president alone.
Now we see the rise of an imperial judiciary that not only legislates from the bench but is attempting to expand their “contempt” power to likewise swallow up our Bill of Rights and circumvent jury trial. Both methods are used to allow the powerful office holder to merely point his finger and have his opponent thrown behind bars without a grand jury indictment and without being found guilty by a jury of their peers. No innocent until proven guilty before a jury. Just “guilty” because the leader says so. That is a dictatorship, whether done by a president or by a judge. No one man should have that kind of power in his hands alone to decide guilt and impose a sentence of indefinite detention. Under our Constitution, that dictatorial power does not exist. Middle school parents in Tennessee are up in arms on learning that their children were instructed to recite and write, “Allah is the only god,” as part of a world history project.
In the Maury County School District, students were assigned a Five Pillars of Islam project that included the translation of the pillar of “Shahada” as being, “There is no god but Allah; Muhammad is his prophet.”Joy Ellis, the mother of a seventh-grader at Spring Hill Middle School, said that Christian children should not be instructed to write the Shahada.
“This is a seventh grade state standard, and will be on the TCAP,” Ellis said. “I didn’t have a problem with the history of Islam being taught, but to go so far as to make my child write the Shahada, is unacceptable.”
Another mother of a seventh-grade girl, Brandee Porterfield, complained to officials at Spring Hill Middle School because of its overemphasis on Islam to the exclusion of Christianity and Judaism.
Porterfield said she has no objections to her daughter learning details of the Islamic religion, but she objects to the fact that the history unit didn’t devote similar time to Christianity or Judaism.

Black Lies Matter: From Ferguson To Olympia
Late Friday evening, 100 “Black Lives Matter” types rioted through downtown Olympia, Washington, on behalf of brothers Andre Thompson and Bryson Chaplin, who were non-fatally shot in May when Officer Ryan Donald tried to apprehend them for stealing beer from a Safeway grocery store.
According to our own Brian Anderson, when Donald exited his vehicle and approached the brothers, one of them attacked him with a skateboard. He then fired several shots, wounding the attacker and sending both brothers scurrying into the woods in cowardice.
A short time later, the brothers “emerged from the woods and went after the officer again, launching a second attack,” during which “Officer Donald put several shots into the torso of one of the brothers and they finally gave up.”

One of New York Gov. Andrew Cuomo's staff members was shot and seriously wounded early Monday before the West Indian Day Parade in the Brooklyn borough of New York, WABC-TV reported. Carey Gabay, 43, was reportedly shot in the head at about 3:45 a.m. in the Flatbush neighborhood.
Officials told the television station Gabay was walking with his brother past people having an argument when shots were fired. He was reportedly hit with at least one bullet and rushed to the hospital, where he is in critical condition.
Cuomo himself did not immediately release the name of the staffer who was shot, but said the man was a 43-year-old graduate of Harvard University with a wife and baby on the way, according to WCBS. A biography of Gabay at the time of his hiring as first deputy counsel of Empire State Development, the New York economic-development agency staffed by Cuomo, appears to match the description given by the governor.
Several incidents of violence broke out before the parade scheduled for Monday. One man was killed in a stabbing and others were wounded by gunfire, including the Cuomo staffer, the Associated Press reported.
The parade celebrates Caribbean culture and features food, music and scores of dancers in bright costumes. Cuomo and New York Mayor Bill de Blasio are both scheduled to attend the event, the first such occasion for the two since July, after a months-long feud, as AP noted.

UPDATE 11:29 a.m. EDT: New York Gov. Andrew Cuomo released a statement on the shooting Monday confirming that 43-year-old staffer Carey Gabay was shot and in critical conditional, via WCBS.
"Carey is a friend to all who have the pleasure of meeting him," the statement read. "I ask that New Yorkers join us by keeping him, his wife Trenelle and his family in their prayers at this time."

The leader behind the “pigs in a blanket, fire them like bacon” chant at a recent #BlackLivesMatter protest said on MSNBC Tuesday night that the chant was meant to be playful, not to incite violence.
“Do those activists, do you, do #BlackLivesMatter activists hate police officers?” asked host Chris Hayes. “No, not at all,”
Trahern Crews responded. “And I want to put that chant in context.”
Crews said the protesters and police were both having a great time. “So on the way back, the officer leading the parade kept talking into his microphone and saying things to the crowd, like, ‘Stay off the medium, do that,’ he was laughing and joking with the marchers, so then the marchers kind of started chanting that towards him. It was more playful than anything.”
“You’re saying, that was in a playful context, that chant?” asked Hayes.
“At that particular demonstration, yes. That was,” Crews said.

Oregon judge refuses to perform same-sex marriages
A circuit court judge in Oregon's Marion County is refusing to perform same-sex marriages, claiming doing so would violate his First Amendment rights.
Judge Vance D. Day, who has served in Oregon's Third Judicial District since 2011, has never married an LGBT couple, and has stopped performing marriages all together. Day says performing gay marriages would go against his religious beliefs, and has reportedly instructed his clerks to refer gay couples to other judges.
While no complaint against Day has been made public, Day spokesman Patrick Korten told KATU that the judge is currently under investigation by the Oregon Commission on Judicial Fitness and Disability. According to KPTV, that investigation was prompted by a 13-point complaint against Day, and will be assessed in a hearing this fall. Day is in the process of setting up a legal defense fund to fight any potential charges.
The judge previously served as the chairman of the Oregon Republican Party.
Day's refusal comes as a clerk in Rowan County, Kentucky, made national headlines for declining to issue marriage licenses to same-sex couples after the Supreme Court legalized gay marriage nationwide. The clerk, Kim Davis, was jailed this week after defying a federal order to issue the licenses.
On Friday, Davis' deputies agreed to comply with the courts and issued a marriage license to James Yates and William Smith, who were previously denied during previous attempts to obtain one in Rowan County.
