Judge: Broward Coward Had No Duty to Protect Students

A federal judge threw out a suit against Broward County ruling that there is no consitutional duty for the police to protect people.

The Sheriff's office (and Office Scot Peterson in particular) came under fire last year for the woefully inadequate response to the Parkland high school shooting last year. Instead of intervening, Peterson sought cover, and hid until more help arrived.

Apparently that was his Constitutional right.

Orlanda Sun has more:

U.S. District Judge Beth Bloom dismissed a suit filed by 15 students who claimed they were traumatized by the crisis in February. The suit named six defendants, including the Broward school district and the Broward Sheriff’s Office, as well as school deputy Scot Peterson and campus monitor Andrew Medina.

Bloom ruled that the two agencies had no constitutional duty to protect students who were not in custody.

“The claim arises from the actions of [shooter Nikolas] Cruz, a third party, and not a state actor,” she wrote in a ruling Dec. 12. “Thus, the critical question the Court analyzes is whether defendants had a constitutional duty to protect plaintiffs from the actions of Cruz.

“As previously stated, for such a duty to exist on the part of defendants, plaintiffs would have to be considered to be in custody” — for example, as prisoners or patients of a mental hospital, she wrote.

Here's the Latest Ways the White House Says It Will Pay For the Wall     Katie Pavlich   Posted: Dec 19, 2018

The White House has climbed down from President Trump's assertion last week that he would shut down the government if he doesn't get funding for a border wall.

Over the past few days, the language has changed as White House officials replace the term "wall" with "border security."

During a briefing at the White House Tuesday, Press Secretary Sarah Sanders said President Trump has asked each of member of his cabinet to look for extra cash. She also argued the new trade agreement with Mexico and Canada, which hasn't made it through Congress, will pay for a wall.

"We're looking at every avenue available to us possible. The President has asked every one of his Cabinet Secretaries to look for funding that can be used to protect our borders and give the President the ability to fulfill his constitutional obligation to protect the American people by having a secure border," Sanders said.

"The President has been clear that the USMCA deal would provide additional revenue through that deal that would show that Mexico was paying for the wall," Sanders continued. "He's saying that the revenue provided and the money that would be saved through the USMCA deal, we could pay for the wall four times over. And by doing that new trade deal, we have the opportunity to pay for the wall."

Counselor to the President Kellyanne Conway argued on Fox and Friends Wednesday morning that the President isn't backing down on his promises for border security.

Meanwhile, Republicans and Democrats appear to have made a deal to avoid a government shutdown.

As in past battles waged by the Democrats against Supreme Court nominees offered by Republican Presidents, beginning with Robert Bork in 1987 and Clarence Thomas four years later, the Minority Party has made crystal clear it will employ a scorched earth strategy; in which neither factual accuracy nor policy relevance will play a role.

Pelosi and Schumer Should Take a Lesson from Bill Clinton

As much as the media obsesses over President Trump, and as much as he exhibits to the media the behavior they love to hate, it is amazing how little the media remembers.

The latest flap over immigration policy, and especially the televised Oval Office meeting just last Tuesday with soon-to-be Speaker Nancy Pelosi and still-Senate Minority Leader Schumer, has the left and its media darlings all in a tizzy.

The fact is, the episode and its aftermath are vintage Trump — pure stagecraft. And anything the president said at that meeting had a shelf life of precisely one news cycle.

The White House meeting was orchestrated by Trump not to announce new substantive policy or signal a major change in policy. Trump has been railing about building the wall since long before he was elected in 2016.

His base continues to support him on that issue, and he knows this. He also must know the polling on the question of whether to build a wall has remained relatively constant over the course of his presidency and does not spike or crater depending on what he says. It’s all about negotiating. Think Bill Clinton.

Letitia James, the newly elected New York attorney general who will replace Underwood next month, reportedly said she will continue investigating Trump and his organizations, including probing real estate deals and other investigations into "anyone" in his circle who could have violated the law.

"We will use every area of the law to investigate President Trump and his business transactions and that of his family as well," James told NBC News earlier this month.

Rudy Giuliani said he was "disgusted" by the tactics used by Robert Mueller in his probe into Russian election interference

With a number of probes moving closer to the Oval Office, President Donald Trump and his attorney unleashed a fresh series of attacks on the investigators, questioning their integrity while categorically ruling out the possibility of a presidential interview with the special counsel.

Trump and Rudy Giuliani used Twitter and television interviews Sunday to deliver a series of broadsides against special counsel Robert Mueller and federal prosecutors in New York. Giuliani said he was "disgusted" by the tactics used by Mueller in his probe into Russian election interference, including in securing guilty pleas from the president's former national security adviser Michael Flynn on a charge of lying to federal investigators.

Trump, Giuliani said, would not submit to an interview by Mueller's team.

"They're a joke," Giuliani told "Fox News Sunday." ''Over my dead body, but, you know, I could be dead."
