Fox News contributor Jonathan Turley joined "The Brian Kilmeade Show" to explain why Jan. 6 was a riot, not a rebellion or insurrection. The constitutional scholar said not only has former President Trump not been charged with incitement or rebellion in the three years since, but that the American people do not view it that way, either. The constitutional law professor said the efforts to disqualify Trump on that basis threaten democracy.

JONATHAN TURLEY: The biggest problem for me is that the 14th Amendment, Section Three, deals with rebellion and/or insurrection. This was neither. This was a riot and at some point, mature minds have got to kick in here and say, look, he has never even been charged with incitement, let alone rebellion and insurrection. But more importantly, putting aside the fact that he hasn't been convicted, this wasn't a rebellion or insurrection. I know that the other side has really tried hard to portray it that way, but the American people don't even view it that way. Polls indicate that the public views this as a protest that became a riot. It doesn't excuse what happened.

We've had violent protests in this country. There were violent protests when Trump was inaugurated. And at that time, there were Democratic members that voted not to certify Donald Trump. Were they also rebellious? What they're suggesting here is really otherworldly. If this is going to be the new theory, it'll be replicated, it'll metastasize throughout the country. I've got a column out in the New York Post talking about the new effort to bar Congressman [Scott] Perry under the same theory that Democratic members of Congress have asked to bar dozens of Republican members of Congress under the same theories. That's the slippery slope that we're about to step on. [...]

It's a tit-for-tat politics. And the terrible thing is that this is the most successful and stable democracy in the history of the world. And yet, after this long successful run, you have blind advocates today trying to introduce an instability in that system that could destroy it. This is the type of theory that can destroy a democracy. And, you know, there's a poll showing that the majority of people do not believe in this disqualification. Some 40% do, but it shows how dangerous this is. We are a divided country and you have people who are trying to win this election in the courts.

A federal judge on Tuesday dismissed most of the civil counts against Trump and two others in connection with the death of Capitol Police Officer Brian Sicknick during the U.S. Capitol riots on Jan. 6.

In a 12-page ruling, U.S. District Judge Amit Mehta dismissed three of the five civil counts in a lawsuit filed last January by Sandra Garza, Sicknick's girlfriend.

Garza's lawsuit against Trump and Jan. 6 rioters Julian Khater and George Tanios sought damages from all three men for claims of wrongful death, conspiracy to violate civil rights, and negligence per se based on D.C.'s anti-riot law.

In his ruling Tuesday, Mehta dismissed the wrongful death act count and both negligence per se allegations.

Tuberculosis (TB), an airborne bacterial infection, has now been confirmed in every neighborhood in New York City, with 88% of cases in people born outside the US. Florida has seen a 21% increase in TB since Biden was elected. Texas border counties have triple the national average rate for TB.

But the list doesn’t stop there:Chickenpox outbreaks have ripped through migrant shelters in multiple states.
Measles, declared eliminated in the U.S. back in 2000, has been brought back to the U.S.
Malaria was reported by a Maryland resident who contracted it from someone who got it outside the U.S. and brought it into our country.
Leprosy is now endemic in the southeastern United States. Leprosy previously affected mainly persons who had immigrated from leprosy-endemic areas.

And that’s just the beginning. Migrant-borne illnesses are transmissible and already spiking nationwide.

WHAT ABOUT THE PIPE BOMBER?
One of the biggest remaining mysteries surrounding the riot is the identity of the person who placed two pipe bombs outside the offices of the Republican and Democratic national committees the day before the Capitol attack. Last year, authorities increased the reward to up to $500,000 for information leading to the person's arrest. It remains unclear whether there was a connection between the pipe bombs and the riot.

Can't find the pipe bomber....even though they have clear pictures from a few locations But, they also had very clear pictures of Ray Epps, directing / telling people where to go, telling them to enter the capitol. They didn't bring charges against him until the public called them out on it so loud, I guess they figured they had to investigate him in order to appear UNBIASED.

So they arrested Epps and.....Under federal sentencing guidelines, he'll face between zero and six months in prison. His sentencing hearing is scheduled for Dec. 19. As part of the plea deal, Epps acknowledged moving through downed police barriers on Jan. 6 and admitted to placing his hands on a sign that was later pushed into police officers by the mob.

There's been no evidence to suggest the conspiracy theory claiming Epps was some sort of plant working for the government who was used as part of a plot to turn the Jan. 6 protests violent is accurate. The FBI in April responded to repeated "60 Minutes" inquiries on the issue with a statement, saying: "Ray Epps has never been an FBI source or an FBI employee."

Under federal sentencing guidelines, Ray Epps will face between zero and six months in prison after pleading guilty to one count of disorderly conduct.

He was seen on a livestream that day saying "I'm gonna put it out there, I'm probably gonna go to jail for this. Tomorrow, we need to go into the Capitol! Into the Capitol! Peacefully! Peacefully."

Epps will also have to pay $500 in restitution.

When people will neither look at the facts nor the evidence, there is a problem. When people seem to be so inundated with a political candidate that truth does not matter anymore, there is a bigger problem. When a candidate can deceive so many so easily so often, there is a huge problem. You can vote for who you want to, but none of these things are normal. Not at all. So in this article we’re going down the rabbit hole.

I am not a Democrat. Still, talking to Trump supporters reminds me of when I counseled and de-programmed ex-cult members who had been brainwashed by cults and their cult leaders. So while I understand politics, hidden agendas, capitalism and the corporate machine, there is something much darker here. Much darker than fear. Much darker than ignorance. Much darker than denial. The MAGA Trump followers have been brainwashed into a cult, and their actions seem as if those who are zombies under a spell or both. Mind control! Yes it exists.

Of course some people wanted to ride the Trump train, because like him, they are opportunists. Of course, some people believed Trump would do a good job. Of course, some people were taken in by what he said and his promises. But what is happening today is much deeper, much darker, and much deadlier than that. We are seeing the manifestation of dark powers and principalities and the puppets they control like Trump.

This Trump cult has a heavy base of racism, the same racism that founded America. Donald Trump represents the real America without the clan robe and hood and torch and rope. His words produce fear and anger. His speeches are full of hate and deception. His actions are full of lawlessness. Donald Trump is a “man of lawlessness”. And yet his diehard supporters cannot see any of this. They represent the real America, a country founded by criminal hypocrite colonizing invaders who fled Europe.

Any time millions of people can support a man with 91 felony charges in 4 separate courts, a man who was impeached, a man who lost a rape case, a man who calls veterans losers, a man who jokes about the handicapped, a man who admits on tape that he sexually molests women at will, a man who tries to overturn a legal election and ignore the Constitution of the United States, a man who insights violence and insurrection against the United States (thereby violating his oath of office), a man who pays off a porn star he used, a man who cheats on his wife, a man who lies more times than the average person can count, a man who used the United States government as his personal piggy bank, a man who kept and shared classified documents, a man who has no problem with Russia meddling in America’s elections, a man who praises and looks up to dictators in other countries, a man who threatens to use the Justice Department of the United States to retaliate against his enemies, a man who quotes Hitler and a man who can blind and deceive millions at will, those people are in a cult and under a spell. In such case, America is dealing with the nature of Satan himself. Or is America simply reaping what it has sown and its prize pupil has arisen?

Donald Trump is not a genius. An examination of his tactics, his failed businesses and marriages can prove that. But what most people need to see is that Donald Trump is getting instructions from something or somewhere. Dark instructions. Instructions from those who he obeys. Trump did not come up with all of this on his own. And those puppet masters who pull his strings are the ones you really need to worry about. They are much more powerful than him, much smarter than him and demand both loyalty and obedience without question. Donald Trump may be the face of the cult, but he is not the head of it. Not by any means. And all of this was planned out before he even got his instructions to run for President .

Unfortunately, that is all that I can say. You may not believe it, but it’s all true. You may not accept it. But so be it. Time will tell and you will see. So whether you are a Republican or Democrat, that doesn’t matter. Presidents are selected before they are ever elected. Your vote is simply to create the illusion of citizen empowerment. That is as far down the rabbit hole as I am going to take you. Open your eyes that you may see.

According to conservative columnist David French, the Supreme Court should give absolutely no consideration to how Donald Trump's supporters would react if he isbanned from running for office — and the court should stick to the letter of the law.

In his column for the New York Times, French claimed the time had finally come to say "enough" over worries the former president will incite more violence, while also maintaining that the 14th Amendment was correctly interpreted by the Colorado Supreme Court when they booted him off the ballot.

More to the point, he added the court's eventual ruling on the Civil War era amendment with regard to the former president is likely to divide the country, and that the justices shouldn't try and find a way around that. They need to step up like previous courts have done in critical cases ranging from Brown v. Board of Education to the recent Dobbs v. Jackson Women’s Health Organization ruling that threw a woman's right to making private health decisions into chaos.

"This is where we are, and have now been for years: The Trump movement commits threats, violence and lies. And then it tries to escape accountability for those acts through more threats, more violence and more lies," French wrote.

"At the heart of the 'but the consequences' argument against disqualification is a confession that if we hold Trump accountable for his fomenting violence on Jan. 6, he might foment additional violence now," he wrote before adding, "Enough. It’s time to apply the plain language of the Constitution to Trump’s actions and remove him from the ballot — without fear of the consequences. Republics are not maintained by cowardice."

As French explained, spending time debating the exact meaning of what constitutes an "insurrection" could go on forever, but there is no doubt, "It’s true that Trump wasn’t declaring a breakaway republic, but he was attempting to “seize and hold” far more than the Capitol. He was trying to illegally retain control of the executive branch of the government. His foot soldiers didn’t wear gray or deploy cannons, but they did storm the United States Capitol, something the Confederate Army could never accomplish."

"So no, it would not be a stretch for a conservative Supreme Court to apply Section 3 to Trump. Nor is it too much to ask the court to intervene in a presidential contest or to issue decisions that have a profound and destabilizing effect on American politics," he advised. "Fear of a negative public response cannot and must not cause the Supreme Court to turn its back on the plain text of the Constitution — especially when we are now facing the very crisis the amendment was intended to combat."

Warning that, "If the court rules against Trump, the nation will be told to brace for violence. That’s what seditionists do," he pointedly wrote of the modern GOP, "Republicans are rightly proud of their Civil War-era history. The Party of Lincoln, as it was known, helped save the Union, and it was the Party of Lincoln that passed the 14th Amendment and ratified it in statehouses across the land.

"The wisdom of the old Republican Party should now save us from the fecklessness and sedition of the new.

Today is a historic day, the day that at least some of the names on the Epstein client list have been revealed.

150 names have been unsealed as part of Epstein’s contacts, network, household employees, and victims. It is important to note that this list is not the comprehensive Epstein client list nor are all the people mentioned perpetrators.

Some are, in fact, victims as I just mentioned above, but it cannot be stated enough. Still, this is an impressive start and a giant step in the right direction.

2023 Wrap-Up: 4 Times Joe Biden Abandoned Americans In Times Of Need

President Joe Biden has a history of abandoning Americans in the midst of emergencies and natural catastrophes, with little chance of enough assistance arriving. Here are four instances in which Americans were left on their own.

During Afghanistan’s bloody and chaotic retreat, the Biden administration claimed to have rescued over 120,000 individuals. However, the administration also left over 800 Americans behind enemy lines. Republicans on the House Foreign Affairs Committee’s initial analysis of the withdrawal revealed that, in contrast to Biden’s claim that there were only 100–200 Americans remaining in Afghanistan, by the time he withdrew all U.S. forces, there were over 800 Americans who had been left behind.

Those who were evacuated by private citizens and non-governmental organizations are not included in that figure.

“The State Department has evacuated more than 800 American citizens from the country since August 31, 2022. That does not include the AMCITS evacuated by outside groups. And it is clearly dramatically more than the number of “about 100” that we were repeatedly told after the NEO [non-combat evacuation operation] ended. For perspective, the Iran hostage situation in 1979 saw 52 Americans left in the country,” according to the committee report.

Furthermore, at least thirteen American service personnel lost their lives in the withdrawal.

In Sudan, as a violent war continued in April, the Biden administration abandoned an estimated 16,000 individual American residents there and expected them to find their own way out. The White House maintained that there were no preparations to assist the thousands of Americans who were left there at the time, even though the government carried out measures to help U.S. Embassy workers escape.

“It’s absolutely imperative that U.S. citizens in Sudan make their own arrangements to stay safe in these difficult circumstances,” said White House National Security Council spokesman John Kirby at the time. “Americans should have no expectation of a U.S. government-coordinated evacuation at this time. And we expect that that’s going to remain the case,” he added.

United States officials came under fire for helicoptering out around 70 embassy employees on one weekend while threatening to withhold a comparable evacuation for thousands of private American citizens in Sudan. However, other nations, including France, dispatched vessels to assist in the evacuation of their population in the interim.

Following a train disaster in February that resulted in a hazardous chemical leak in East Palestine, Ohio, which killed wildlife and contaminated the local water and air, Biden announced that he would visit the site. Jessica Conard, a local resident in East Palestine who saw the incident unfold from her backyard, told The New York Times that she was relieved to hear Biden’s announcement, since she assumed that his presence would announce to the world that a calamity had occurred and that it would help get the town some funding. However, Biden went back on his promise and never made the visit to East Palestine.

“I feel like I don’t matter,” said Conard, who said that she voted for Biden in 2020, adding that she was “aghast” when she heard that the president flew over East Palestine in September to meet union workers in another state that is a key swing state.

Additionally, Biden issued an executive order directing federal agencies to carry out evaluations in order to hold Norfolk Southern accountable, rather than signing a disaster declaration, which would have permitted the state to access federal resources.

“I haven’t had the occasion to go to East Palestine. There is a lot going on here and I haven’t been able to break,” Biden said. “I figured I would go to East Palestine this week, but I was then reminded that I have to go around the world. I’m going from Washington to India to Vietnam and so it is going to be a while. But, we are making sure that East Palestine has what they need materially in order to deal with the problems.”

“But where do you go?” Conard continued. “Where do you go when your community is repeatedly ignored by the president of the United States? That’s where I want to go. I want to go where I feel like an American worth saving.”

On Saturday, October 7th, Hamas carried out a large terrorist strike in southern Israel. At the time, Americans who were in the country were unable to contact the U.S. Embassy and initially had to find other means of returning home. However, Biden decided to let off some steam by throwing a barbecue at the White House one day following the attack that resulted in the deaths of Israelis and Americans, as well as the kidnapping of hundreds.

Silver Prout, one American who was visiting Israel with a church group, said that because the embassy was closed on Monday, October 9th, in observance of Columbus Day, they were unable to get in touch with anybody there for several days.

“They need to start getting Americans out,” said Prout, who was among the 46 U.S. citizens stuck in Israel. “Where is the State Department?”

Marjorie Taylor Greene Rebukes Mike Johnson's 'Hypocrisy'  Dec 31, 2023 at 1:18 PM EST

Representative Marjorie Taylor Greene, a Georgia Republican, criticized House Speaker Mike Johnson, a Louisiana Republican, on Saturday for his "hypocrisy" when dealing with a looming government shutdown.

Before Johnson was elected as speaker in late October, he told his GOP colleagues that he would put a stopgap bill on the House floor if needed to avoid a government shutdown. He did just that in November with what he described as a "laddered" continuing resolution or CR.

The CR, which was ultimately passed, extends government funding for the Veterans Affairs Department, Transportation Department, Housing and Urban Development Department and Energy Department, as well as for military construction until January 19. The rest of the government has funding until February 2.

In an interview with The Hill that was published Saturday, Greene called out the "hypocrisy" of Johnson's plan, which is similar to an effort made by former House Speaker Kevin McCarthy, a California Republican, that contributed to his removal of the position in early October.

Tucker Carlson expressed concern that Diversity Equity and Inclusion (DEI) ideology, which rewards groups based on race and gender while demonizing others, could lead to violence if allowed to continue.

He likened DEI to Jim Crow laws and emphasized the need for a colorblind meritocracy to preserve a pluralistic society.

Carlson stressed that the future of the US depends on merit-based systems and warned of potential violence if the ideology persists. (Trending: Trump Releases Must-See TV Ad Ahead of 2024)

He attributed the ideology’s spread to “white guilt and self-hatred” and condemned it as immoral, akin to Jim Crow and the Nuremberg laws.

“I mean, it’s grotesque. The idea that certain people on the basis of immutable characteristics get certain privileges and other people are hurt on the basis of their immutable characteristics, like that’s totally incompatible with America,” Carlson said.

“It’s gotta be a colorblind meritocracy or it can’t keep going because it’s a pluralistic society. There’s no majority of anything that has anything in common,” he added.

“And also, by the way, we’re going to get to violence really soon if this stuff continues,” he said.

“If you tell people that this group or that group is bad because they’re in that group, because they look a certain way or because their parents looked a certain way, if you tell them that over time, that group’s going to get hurt.”

“And we don’t need to guess about this. Well, actually, it happened in Europe not that long ago, but it’s happened throughout history.”

“It’s totally immoral, it’s the thing we said we hated Jim Crow and the Nuremberg laws. I mean name it it’s like it’s the original sin of man attacking people on the basis of things that they can’t control they were they were born with.”

On Dec. 28, 2023, Maine Secretary of State Shenna Bellows -- after a bipartisan group of former state lawmakers filed a challenge against Donald Trump's eligibility for office based on the 14th Amendment's "insurrectionist ban" -- announced a decision to remove the former president from the state's 2024 ballot.

"I do not reach this conclusion lightly," she wrote of her decision. "Democracy is sacred … I am mindful that no Secretary of State has ever deprived a presidential candidate of ballot access based on Section Three of the Fourteenth Amendment. I am also mindful, however, that no presidential candidate has ever before engaged in insurrection."

The decision came days after Colorado's Supreme Court issued a 4-3 ruling declaring that the likely Republican presidential nominee for 2024 is ineligible for office because he engaged in an insurrection on Jan. 6, 2021, at the U.S. Capitol.
