The Biden administration is in full retreat over its unlawful vaccine mandate. After wreaking havoc on the U.S. economy for months by mandating that federal contractors and businesses with more than 100 employees force employees to get ‘vaccinated’ for Covid-19, the White House is conceding it needs to suspend the authoritarian policy.

The Occupational Safety and Health Administration announced that it was suspending the federal vaccine mandate’s enforcement:

On Nov. 16, 2021, the federal Occupational Safety and Health Administration (OSHA) announced it is suspending all implementation and enforcement efforts related to the Emergency Temporary Standard (ETS) on mandatory COVID-19 vaccination and testing in the workplace. The announcement follows the Nov. 12, 2021 order from the Fifth Circuit Court of Appeals staying enforcement of the ETS pending a final ruling on its legality. OSHA intends to resume implementation and enforcement of the ETS following litigation, if permitted. This newly stated position immediately impacts employers with 100 or more employees who are not federal contractors or otherwise subject to Centers for Medicare and Medicaid Services’ guidance. Such employers can breathe easier, as they are no longer faced with Dec. 5, 2021 and Jan. 4, 2022 compliance deadlines associated with implementing a vaccine mandate or weekly testing program.

The Republican Party’s official account pointed to an “onslaught of legal challenges” for the reason OSHA is backing off enforcing the policy.

Mark and Patricia McCloskey, the St. Louis couple who had faced gun arges after arming themselves against Black Lives Matter protesters near their home last year, are in Kenosha, Wisconsin, to support Kyle Rittenhouse as the jury nears its deliberations in his trial.

The McCloskeys were seen on Monday near the Kenosha County Courthouse as the jury heard closing arguments. Rittenhouse is charged with first-degree reckless homicide, first-degree intentional homicide and other offenses for shooting three men, two of whom died, in August 2020.

“We feel for Mr. Rittenhouse,” Mark McCloskey told Fox News. “We feel he acted in self-defense.

“We think he’s been politically prosecuted, as were we, and we’re hoping that the jury find him not guilty on all counts and that he can go home a free man.”

The McCloskeys pleaded guilty to a misdemeanor charge, and they were pardoned by Missouri Gov. Mike Parson.

“A young man, he was doing the best he could to help his country and to save businesses up here in Kenosha, and as his reward, he’s having the rest of his life threatened,” McCloskey told Fox News.

Mark McCloskey, who is running for Senate in Missouri, said he is in Kenosha to show support for the 18-year-old, who was 17 at the time of the shootings. Rittenhouse’s defense team asserts that Rittenhouse fired in self-defense.

“I’m not going to show up to the courthouse until the jury is out so that we don’t get accused of interfering in any way of the results,” he said.

Attorney General Merrick Garland has been accused of lying to Congress after House Republicans released documents provided by a whistleblower that allegedly show the FBI investigated parents critical of local school boards using “counterterrorism tools.

The documents purportedly show the FBI created a tag for threats against teachers and school administrators.

The ‘threat tag’ was formulated as part of the bureau’s implementation of a controversial memo published by Garland that mobilized the FBI to address parents who ‘pose a threat’ at school board meetings.

That memo was developed after the National School Boards Association (NSBA) along with the White House and the Department of Justice (DOJ) coordinated to create a controversial letter comparing concerned parents to domestic terrorists.

House Republicans released an email showing the FBI advised agents to apply the threat tag “EDUOFFICIALS” to all investigations of threats directed specifically at education officials.

Former Trump aide and strategist Steve Bannon turned himself in to the FBI field office in Washington D.C. Monday morning after being indicted by a federal grand jury for contempt of Congress.

Bannon indicated he would not comply with a subpoena to appear before the House committee citing executive privilege.

He was then indicted last week by the Department of Justice on two counts of contempt of Congress. He was charged with one count related to his refusal to appear for a deposition and another related to his refusal to produce documents.

The House Committee is looking into the events of January 6, 2021 when protests over what was believed by many to be a fraudulent election turned violent and a riot ensued at the Capitol building.

Not Backing Down

Steve Bannon appeared to be defiant and undaunted by the indictment as he urged his and Trump supporters to keep focused on the tasks at hand. To supporters outside the FBI office and on a social media live stream he said, “I don’t want anybody to take their eye off the ball of what we do every day.”

He continued saying, “We got the Hispanics coming on our side, African Americans coming on our side. We’re taking down the Biden regime every day. Remember: Signal not noise. This is all noise, that’s signal.”

 In the case against Kyle Rittenhouse, there is one guilty party that will never be prosecuted, never put on trial, never held accountable for their role in the shootings that could land Rittenhouse in jail. That party is every single person who spent the summer of 2020 excusing and even justifying the violent riots that led Rittenhouse to Kenosha, Wisconsin, in the first place.

What happened in Kenosha that summer was horrific lawlessness on display, and no one, not even the governor of Wisconsin, wanted to do anything about it, because to take a stand against the riots meant drawing the wrath of leftist activists who had convinced themselves that rioting, looting, arson, and other forms of violence were not just understandable but necessary.

This is not   an exaggeration. Article after article after article was published to convince the public that the violence they were seeing across the country was a normal expression of frustration to which minority communities had the right — never mind that many of the rioters were white people burning down black-owned businesses. And any time someone suggested that the lawlessness be forcibly put down, the Left and its allies in the media cried racism.

As a result, Democratic government leaders who were charged with protecting their communities and citizens abandoned this duty for fear that the political consequences would be worse if they took a stand against rioting than if they did nothing at all. Hence, Wisconsin Gov. Tony Evers refused to send additional law enforcement to Kenosha until it was too late.

The cost was utter chaos and death. Police officers were physically attacked, businesses were burned to the ground, and the mayor of Kenosha was forced to flee during the middle of a press conference by a crowd that smashed its way into the building. For many of the people who lived in Kenosha, there was no end in sight to this madness because no one seemed to have the guts to end it.

Enter Kyle Rittenhouse and the dozens of other citizens who felt they needed to take the defense of the city into their own hands.

It is fair to argue Rittenhouse should never have been there that night. It is also fair to describe what he was doing as attempted vigilantism. But the fact remains that Rittenhouse likely would not have been in Kenosha at all had it not been for the total breakdown in law and order encouraged by the leftist media and sanctioned by Wisconsin’s Democratic government.

The tragedy in Kenosha is an indictment of every single person who justified the rioting and every single government official who failed to use the full force of the law to end it. That a 17-year-old boy felt the responsibility to help the government do its job is not a mark against him but against everyone who abandoned that responsibility and left it to him.

Not one resident in Kenosha should have been worried about businesses being looted or burned down. Not one resident should have felt the need to step in and help law enforcement meet the threat. There should have been an overwhelming, forceful response from the state and federal governments that left no doubt in anyone’s minds that chaotic violence would not be tolerated.

If that had happened, would Rittenhouse even be on trial today?

During the Revolutionary War, the British used a number of prison ships to hold captured American soldiers, sailors, and dissidents.  Called “Hell” by its crew, the HMS Jersey held up to 11,000 prisoners – only 1400 of which were left alive at the end of the War.  What happened to Americans during their incarcerations can only be called cruel and unusual.

The 8th Amendment to United States Constitution prohibits cruel and unusual punishment. However, it does not define what is meant although in is recognized in law to involve punishment disproportionate to an offense and torture (degradation and unnecessary infliction of pain). Unfortunately, both of these definitions have been and continue to be tested. The most current example being the treatment of Americans who protested election fraud at the US Capitol on January 6, 2021.

The disproportionate nature of the imprisonment of the January 6th protestors is obvious. When compared to the almost turnstile “pay and go” justice associated with the Kavanaugh hearing protests and the numerous nationwide ANTIFA/BLM attacks, the holding of January 6th protestors is not just disproportionate but horribly so. These prisoners, housed indefinitely in the DC jail, have been effectively “sentenced” without a trial, and without access to non-partisan judges. That is both cruel and unusual.

Torture during this imprisonment has also been reported. Notably, the specifics of the torture, when compared to the situation of the GITMO prisoners, are degrading. Whereas a GITMO prisoner had access to Islamic religious practices, January 6th protestors have apparently been denied access to Christian religious practices. Torture has also included denial or delays of medical care and basic cleanliness. Again, this is in contrast to the GITMO prisoners whose health and wellbeing were constantly addressed. Finally, and this is by no means the final word on torture, the January 6 protestors are held in extreme isolation conditions that allow for a few hours outside their cell for exercise or meetings with preapproved persons and attorneys. This contrasts with the GITMO prisoners who had far more humane treatment.

It has also been reported that January 6th prisoners have been beaten and physically injured while in their cells. Reports have filtered out that many black prison guards see the white protestors as racists – and react with racial animus. If this is the case, then the beatings, gassings, and other physical torture is unnecessary to control the inmates but is done to savage what is seen as a group of evil white people.

In order to escape the conditions in the DC prisons, January 6th protestors have been forced to appeal to “left leaning” judges by condemning the previous holder of the presidency, Donald Trump. Essentially, unless a January 6th prisoner prostrates himself on the altar of leftwing political correctness, he will not be able to escape incarceration. Since trial dates have been left to an all too often questionable future, the current incarceration amounts to an indeterminate long term or even life sentence. This is something far less than the 6th Amendment “right to a speedy trial” human rights enshrined in the Constitution.

At this point, the January 6th protestors are political prisoners. Incarceration in the DC Jail has proven to be both physically and mentally cruel, and it is amazing that none of these prisoners have died. (Unfortunately, many who have been released are now suffering from previous “denial of care” physical problems as well as mental problems similar to PTSD. One January 6th prisoner, still in his cell, is now on a hunger strike.) What happened on January 6th may be a disgrace but what is now happening in the DC jails is compounding and magnifying this disgrace. The American government has clearly and with malice usurped the constitutional rights of these American citizens.

One final point, Democrat leaders, now embracing socialism, have consistently demonstrated a dislike for and even hatred of the Constitution and its limits on government. Unfortunately, too many Republican leaders ignore these abuses of the Constitution. America is in trouble because the Constitution that protects us all is now being torn asunder.

Oklahoma National Guard rejects federal vaccine mandate      by Misty Severi, Breaking News Reporter| November 13, 2021

The Oklahoma National Guard rejected the Department of Defense's vaccine mandate Thursday, telling the troops they will not be penalized or punished for not getting vaccinated against COVID-19.

The order handed down from Brig. Gen. Thomas Mancino, who was appointed earlier this week by Oklahoma's Republican Gov. Kevin Stitt, is in contrast to the prior adjutant who had advocated for all soldiers and airmen to be vaccinated. However, a spokeswoman for the governor told the Associated Press that the change in leadership had nothing to do with the mandate.

Stitt, who is against a federal vaccine mandate, wrote a letter to Secretary of Defense Lloyd Austin requesting a suspension of the vaccine mandate for Oklahoma's National Guard.

"This mandate violates the personal freedoms of many Oklahomans, as it asks them to potentially sacrifice their personal beliefs in order to not lose their jobs," Stitt said in the letter. "All of our National Guardsmen take this calling very seriously. These are patriotic citizens who are willing to put their lives on the line to protect others in our communities during times of greate
Stitt added that it was irresponsible to require a vaccine mandate that would limit the number of people he could call upon in times of state emergencies.

The Pentagon did not appear receptive to Stitt's request.

“We will respond appropriately,” John Kirby, a Pentagon spokesman, told the Washington Post . “That said, Secretary Austin believes that a vaccinated force is a more ready force. That is why he has ordered mandatory vaccines for the total force, and that includes our National Guard, who contribute significantly to national missions at home and abroad.”

More than 800 guard members have not received the vaccine, which the governor claims is 10% of the force, Stitt's letter said.

The National Guard is usually controlled by the state , but the president has the power to federalize the guards at any time, which would require the guards to receive the vaccine. Because President Joe Biden has not federalized the guards in Oklahoma, the state mandate stands.

National Guard members account for 28% of the 75 COVID-19 related deaths in the military, the highest death toll among the armed forces, according to Pentagon data reviewed by the Washington Po

Most of the records are communications and related attachments between Perrin Larton, a procurement manager for ABR, and research veterinary medical officer Dr. Kristina Howard of the FDA.

White House chief of staff Ron Klain’s itchy Twitter finger helped derail the Biden administration’s latest vaccine mandate in court.

A Sept. 9 retweet from Klain was cited as a key piece of evidence in the blistering ruling issued Friday by the 5th US Circuit Court of Appeals in New Orleans, which paused President Biden’s “staggeringly overbroad” rule forcing COVID-19 vaccines on millions of American workers.

In a footnote, the three-judge panel pointed to Klain’s retweet of a post from MSNBC anchor Stephanie Ruhle, who praised Biden’s mandate — enforced by the federal Occupational Safety and Health Administration — as “the ultimate work-around” to avoid sticky constitutional challenges.

Circuit Judge Kurt Engelhardt characterized the retweet as a White House “endorsement of the term ‘work-around’” — leading the panel to block the mandate on just those legal grounds.

“The public interest is … served by maintaining our constitutional structure and maintaining the liberty of individuals to make intensely personal decisions according to their own convictions,” Engelhardt wrote.

He was bashed in October for approvingly quote-tweeting a post from Harvard economist Jason Furman that described rising inflation and nationwide supply-chain woes as “high class problems.”

The Department of Justice pledged Saturday to “vigorously defend” the mandate in court.

“This decision is just the beginning of the process for review of this important OSHA standard,” a DOJ spokesperson said, according to Fox News. “The Department will continue to vigorously defend the standard and looks forward to obtaining a definitive resolution following consolidation of all of the pending cases for further review.”
