Constitutional Lawyers Argue Mar-a-Lago Warrant Had No Legal Basis By Brian Freeman | Tuesday, 23 August 2022
A former president's right under the Presidential Records Act trumps the statutes the FBI cited to justify the Mar-a-Lago search, David Rivkin Jr. and Lee Casey argued in an opinion piece in The Wall Street Journal on Tuesday.
The two constitutional lawyers, who served at the Department of Justice and the White House Counsel's Office in the Reagan and George H.W. Bush administrations, stressed that the warrant used to search former President Donald Trump's residence suggests that''the FBI had no legally valid cause for the raid.''
This is because Trump's possession of the documents at his residence is entirely consistent with federal law that gives former presidents access to them, regardless of the statutes the FBI uses as justification in its warrant.
The authors emphasized that nothing in the PRA of 1978 suggests that the former president's physical custody of his records can be considered unlawful under the statutes on which the Mar-a-Lago warrant is based.
Rivkin and Casey explained that ''in making a former president's records available to him, the PRA doesn't distinguish between materials that are and aren't classified. That was a deliberate choice by Congress, as the existence of highly classified materials at the White House was a given long before 1978, and the statute specifically contemplates that classified materials will be present — making this a basis on which a president can impose a 12-year moratorium on public access.''
The authors also argue that since the FBI was initially satisfied with the installation of an additional lock on the relevant Mar-a-Lago storage room, if that turned out to be insufficient, and ''Trump refused to cooperate, the bureau could and should have sought a less intrusive judicial remedy than a search warrant — a restraining order allowing the materials to be moved to a location with the proper storage facilities, but also ensuring Mr. Trump continuing access."
Rivkin and Casey added that ''surely that's what the government would have done if any other former president were involved.''

The left likes to project their party’s own offenses onto Trump, such as collusion with a foreign entity, which points more succinctly to Hunter Biden and the Burisma deal, or more recently that Trump has violated the Presidential Records Act when he allegedly kept classified documents from the National Archive, which more closely fits Hillary Clinton and her deletion of thousands of emails containing top secret information.
MSNBC Tiffany Cross asked guest Andy Weber, a former Department of Defense official, who could have the most to benefit from “trafficked” information pertaining to nuclear secrets. “You think about Donald Trump’s relationships with the Saudis, his relationships with the Russians, and the fact that he really appears to have no allegiance to America,” Cross added.
“We don’t know what information was in these documents. But my best guess would be, President Putin would stand the most to gain, to having access to our most classified nuclear weapons information,” Weber answered.
Cross then called the former president a traitor and the panel began to fantasize about what the possible punishment would be. They then brought on a legal analyst who said that Trump could face up to ten years in prison.
“The punishment, under the statute that is cited in the search warrant materials, it’s a ten-year federal felony,” Kirschner stated, suggesting Trump committed “a violation of 793, which is gathering, transmitting, or losing national security or national defense information,” the analyst said.
Republicans have criticized the Department of Justice and the FBI for their partisan raid on Trump, whose lawyers claim that the FBI demanded they turn off the cameras as they forcefully entered the home with backpacks and stayed for nine and a half hours.

Newly reviewed memos between the Biden White House and the FBI, DOJ, and the National Archives show the White House as early as April was involved in discussions surrounding Trump’s papers and documents. According to documents reviewed by Just the News, then White House Deputy Legal Counsel Jonathan Su this May told the National Archives President Biden would “not object to waiving [President Trump’s] claims of executive privilege.”
This statement from Joe Biden’s White House served as the green light for DOJ to procure a subpoena demanding Trump return papers from his presidency that might be at Mar-a-Lago.
A May 10 letter from Acting National Archivist Debra Steidel Wall to Trump’s legal team confirmed the White House’s role and prior knowledge in the DOJ probe against Trump:
“On April 11, 2022, the White House Counsel’s Office — affirming a request from the Department of Justice supported by an FBI letterhead memorandum — formally transmitted a request that NARA provide the FBI access to the 15 boxes for its review within seven days, with the possibility that the FBI might request copies of specific documents following its review of the boxes,” wrote Wall.
Wall goes on to justify ignoring Trump’s executive privilege citing President Biden himself:
“The Counsel to the President has informed me that, in light of the particular circumstances presented here, President Biden defers to my determination, in consultation with the Assistant Attorney General for the Office of Legal Counsel, regarding whether or not I should uphold the former President’s purported ‘protective assertion of executive privilege.’ …I have therefore decided not to honor the former President’s ‘protective’ claim of privilege.”
These correspondences confirm the Biden White House directly participated in a process key to empowering the DOJ raid on Trump’s Mar-a-Lago residence on August 8.
Ultimately, these revelations cast doubt on statements by Biden officials claiming no advance knowledge of the raid and raise more questions about what Biden officials did know prior to the August 8 raid.
California is reportedly going to ban the sale of new gasoline-powered cars by 2035. It’s the first state to do so, and it could end up having a major impact on the U.S.’s transition to electric vehicles, per a report from The New York Times.
“California will now be the only government in the world that mandates zero-emission vehicles,” Margo Oge, an EV expert who has led the EPA’s transportation emission programs for years, told the Times. “It is unique.”
The rule, issued by the California Air Resources Board, will require that 100 percent of all new cars sold in the state by 2035 be free of the fossil fuel emissions chiefly responsible for warming the planet, up from 12 percent today. It sets interim targets requiring that 35 percent of new passenger vehicles sold in the state by 2026 produce zero emissions. That would climb to 68 percent by 2030.
The Times says the new restrictions are important for two big reasons. First, California is the biggest car market in the U.S. Second, as California goes, so goes the nation. Over a dozen states in the country have been known to follow California’s lead when setting their own vehicle emissions standards.
“The climate crisis is solvable if we focus on the big, bold steps necessary to stem the tide of carbon pollution,” Gavin Newson, California’s governor, said in a statement.
Experts said the new California rule, in both its stringency and reach, could stand alongside the Washington law as one of the world’s most important climate change policies, and could help take another significant bite out of the nation’s emissions of carbon dioxide. The new rule is also expected to influence new policies in Washington and around the world to promote electric vehicles and cut auto pollution.
The Times says that at least 12 other states could soon adopt a similar policy. On top of that, five more that follow the Golden State’s broader vehicle pollution reduction program are expected to create a similar rule in about a year. All in all, that would mean about 30 percent of all states in the country would have similar gas bans.

Trump Received A Subpoena And Was Cooperating With Feds Before Mysterious Raid
(RoyalPatriot.com )- Biden’s FBI searched Mar-a-Lago this week after subpoenaing Trump in the spring.
John Solomon stated that Trump cooperated with federal officials and placed an extra lock on his Mar-a-Lago storage container.
Trump posted on Truth Social confirming the report.
In early June, the DOJ and FBI asked his legal representatives to put an extra lock on a Mar-a-Lago storage door. They agreed. The FBI saw the guarded area and boxes. An army of agents broke into Mar-a-Lago on Monday and pulled out the lock.
“Surprise assault, politics, and our country is going to HELL!” he wrote.
Two months before the FBI raided Trump’s Florida property, a grand jury subpoenaed National Archives materials. He readily turned over evidence, surrendered surveillance film, and let federal agents and a top Justice Department lawyer inspect his storage locker.
Trump provided the necessary materials voluntarily. Biden’s jackbooted thugs invaded Trump’s home two months later. FBI investigators searched Trump’s possessions while his lawyers waited outside in the heat.
The subpoena demanded all remaining classified materials Trump has, including images of foreign leaders, letters, and presidential keepsakes.
Officials say Secret Service personnel enabled the visit.
According to two witnesses, Trump indicated his full cooperation by telling the agents and the prosecutor, “Look, whatever you need, let us know.” The president’s offer caught the federal team off guard, and they immediately requested a favor: access to the 6-by-10-foot storage vault at the complex where his clothes, shoes, documents, and other presidential memorabilia were kept.
Recall that in 2009, Barack Obama traveled to Chicago with 30 million pages of White House paperwork.
In a move that infuriated historians, Barack Obama trucked 30 million pages of his administration’s records to Chicago at the end of his presidency with the promise to digitize and eventually post them online. According to the National Archives website, zero pages have been digitized and made public more than five years after Obama’s presidency ended.
His home was never raided.

Former President Donald Trump announced a lawsuit Monday seeking an audit and return of the items taken from his Mar-a-Lago home in an FBI raid earlier this month.“We have just filed a motion in the U.S. District Court for the Southern District of Florida strongly asserting my rights, including under the Fourth Amendment of our Constitution, regarding the unnecessary, unwarranted, and unAmerican Break-In by dozens of FBI agents, and others, of my home, Mar-a-Lago, in Palm Beach, Florida,” Trump wrote in a statement.
He specifically singled out alleged requests from FBI agents to turn off security cameras during the raid.
“They demanded that the security cameras be turned off, a request we rightfully denied,” Trump wrote. “They prevented my attorneys from observing what was being taken in the raid, saying ‘absolutely not.’ They took documents covered by attorney-client and executive privilege, which is not allowed. They took my passports. They even brought a ‘safe cracker’ and successfully broke into my personal safe, which revealed…nothing!
“We are now demanding that the Department of ‘Justice’ be instructed to immediately STOP the review of documents illegally seized from my home. ALL documents have been previously declassified.”
Trump wrote he and his team want a special master to be appointed with a goal “to oversee the handling of the materials taken in the raid.”
“We are further demanding that the DOJ be forced to turn over a REAL, without ‘plants,’ inventory of my property that was taken and disclose where that property is now located,” he wrote. “We are demanding that all items wrongfully taken from my home be IMMEDIATELY returned.”
He also took aim at Judge Bruce Reinhart, who approved the warrant that allowed FBI agents to raid Mar-a-Lago, the New York Post reported.
“The wrongful, overbroad warrant was signed by a Magistrate Judge who recused himself just two months ago, from a MAJOR civil suit that I filed, because of his bias and animus toward me,” Trump wrot
In conclusion, Trump called the FBI raid “illegal and unconstitutional.” He said he wanted the FBI to return the documents taken from his home “so that I can give them to the National Archives until they are required for the future Donald J. Trump Presidential Library and Museum.”
“I will never stop fighting for the American people, our Country and the Rule of Law,” Trump wrote. “Make America Great Again!”

Former House Speaker Newt Gingrich scolded Rep. Liz Cheney, R-Wyo., for assuming the role of "moral judge" and claiming that many Republicans are "sick" for supporting former President Donald Trump.
Cheney on Friday told ABC News that "large portions of our party, including the leadership of our party, both at a state level in Wyoming as well as on a national level with the RNC [Republican National Committee], is very sick" for backing Trump.
She spoke three days after losing to Trump-backed Harriet Hageman in the Wyoming GOP primary 66.3% to 28.94%, according to Decision Desk HQ election returns.
"To go back home to the people that you claim to represent, to only get 29% support and then decide that the other [66] that they're the ones who are wrong. They're the ones who are sick,” Gingrich told Fox News Channel on Monday. "I think that Liz has arrogated to herself a standard of being the moral judge of millions and millions of Americans, around 73 or 75 million Americans who voted for Trump because they're 'sick.'
"They voted for Trump because they deeply dislike the establishment. And no matter what you tell them about Trump, they dislike the establishment even more."
Gingrich chastised members of the anti-Trump establishment for not asking themselves, What are we doing that repels so many Americans?
"Wyoming's a great example," Gingrich told Fox News. "The Cheney name was at one time magic. Now it doesn't just get beat, it gets humiliated.
"I mean, 29% is a sign that — take away the Democrats who switched parties to vote for her — she got probably 1 in every 4 Republicans. It's amazing. So, I don't take what she says very seriously."
The former speaker added that some of Cheney's feeling toward the former president could derive from "a deep policy difference" because "Trump ran, in many ways, as a repudiation of the Bush-Cheney administration."
