This is the definition of disingenuous. Every Justice is hand-picked.
Article 2, Section 2, Clause 2 of the Constitution:
"...and [the President] shall nominate, and by and with the Advice and Consent of the Senate, shall appoint...Judges of the Supreme Court...."
