Manslaughter Case

Baldwin, 65, faced involuntary manslaughter charges for the October 21, 2021, shooting of 42-year-old cinematographer Halyna Hutchins on the New Mexico set of the Western film. A prop pistol he used in a scene mistakenly fired a live round.Baldwin pleaded not guilty to the charges brought by the Santa Fe district attorney. His lawyers, Luke Nikas and Alex Spiro, said in a statement, “We are pleased with the decision to dismiss the case against Alec Baldwin, and we encourage a proper investigation into the facts and circumstances of this tragic accident.”
During the incident, “Rust” director Joel Souza was behind Hutchins, looking at a camera angle as Baldwin rehearsed a scene where he was to draw his revolver and point it at the camera. Souza was also injured in the shooting, with the bullet hitting his shoulder.
Filming for the movie will continue in Montana this week. Hannah Gutierrez-Reed, the film’s former armorer and a second person charged with involuntary manslaughter, still faces charges related to the shooting.
Assistant director David Halls, a third person involved in the on-set tragedy, pleaded no contest to a single count of petty misdemeanor negligent use of a deadly weapon. He gave the gun to Baldwin but failed to check for live rounds.
Hutchins was treated at the scene and then transported to the University of New Mexico Hospital, where she died. The Santa Fe District Attorney’s Office did not immediately respond to a request for comment.
Even though Baldwin claimed he never pulled the trigger, FBI investigators found no other way the shot could have been fired. They discovered a mix of live rounds and dummy bullets on the set, a serious safety violation.
According to previous police documents, the ammunition was left unsecured on a cart during a lunch break on the day of the shooting. The agency reported that the gun could not fire without the trigger being pulled.
In January, a special prosecutor claimed that Hutchins would be alive if proper steps were taken. Andrea Reeb said, “If any one of these three people — Alec Baldwin, Hannah Gutierrez-Reed, or David Halls — had done their job, Halyna Hutchins would be alive today. It’s that simple.” Reeb later stepped down from the case after Baldwin’s lawyers challenged her role as a New Mexico lawmaker.
Hutchins’ family sued Baldwin in February, arguing that he was responsible for her death because he held the weapon. Their attorney, Brian Panish, stated, “He had the gun, he says he pulled the hammer back, it fired, and she was killed. … The experts will look at it and make any determinations, but we don’t think this was caused by any defect in the weapon.” Baldwin is seeking to have the lawsuit dismissed.
