Supreme Court halts fines against mystery company possibly linked to Mueller investigation  Kelly Cohen   15 hrs ago



Supreme Court Chief Justice John Roberts issued a temporary administrative stay of contempt sanctions that have been brought against an unknown company in a mysterious grand jury subpoena fight thought to be linked to special counsel Robert Mueller.

The move is a fairly procedural one, and gives the federal government until Dec. 31 to respond. Roberts, or all of the Supreme Court, could easily decide to lift the stay even before then, depending on how soon as it hears from the federal government.

However, the stay is not relief against the grand jury subpoena, but rather a contempt citation brought by the federal government against the company, known only as "the Corporation."

"The Corporation," which is owned by a nation identified only as "Country A," has thus far refused to comply with a grand jury subpoena issued in federal court in Washington in a case that has remained extremely secretive.

The challenge reached the Supreme Court after the U.S. Court of Appeals for the District of Columbia Circuit on Tuesday night. rejected the company's appeal to quash the grand jury subpoena to turn over records.

Then on Saturday, the company formally filed an application with the Supreme Court, asking it to intervene and stay the lower court's decision to comply with the subpoena — and also asked that the case remain under seal.

The company had also asked the Supreme Court to halt the continuing $5,000 per week fine it is incurring for not complying with the subpoena, an effort Judges David S. Tatel, Thomas B. Griffith, and Stephen F. Williams of the D.C. Circuit also rejected this week.

On Thursday and Friday, there was sealed action in the case at the D.C. Circuit. The D.C. Circuit denied a motion filed by the company, but no other information regarding the motion was revealed.

CNN decided to "investigate" the number of people who lie on the 4473 forms, which are used when someone purchases a firearm. It asks basic questions like your name, address, date of birth and if you've committed a number of criminal violations. When you fill it out you check a simple "yes" or "no" on each question. Lying on 4473 is a felony that can result in a hefty fine and up to 10 years in prison.

What's silly is it took an "investigation" for CNN to realize a fact that gun rights advocates have been saying for years: criminals lie. And the Department of Alcohol, Tobacco, Firearms and Explosives (ATF) very rarely prosecutes those who are caught lying on the form.

US pledges $10.6B aid for Central America, southern Mexico

MEXICO CITY (AP) — The United States pledged $5.8 bilion in aid and investment Tuesday for strengthening government and economic development in Central America, and another $4.8 billion in development aid for southern Mexico.

The U.S aid aims to promote better security conditions and job opportunities as part of a regional plan to allow Central Americans and Mexicans to remain in their countries and not have to emigrate.

The plan was announced in a joint U.S.-Mexican statement released by the State Department and read aloud by Mexican Foreign Relations Secretary Marcelo Ebrard in the Mexican capital.

“In sum I think this is good news, very good news for Mexico,” Ebrard said.

Newly inaugurated President Andres Manuel Lopez Obrador waxed poetic about the plan to provide jobs so people won’t have to emigrate.

“I have a dream that I want to see become a reality ... that nobody will want to go work in the United States anymore,” Lopez Obrador said at a morning news conference before the announcement.

The combination of public and private investment for the stay-at-home effort doesn’t require congressional approval, unlike Trump’s signature project to stem illegal immigration — a border wall.

The U.S. State Department issued a simultaneous statement saying “The United States is committing $5.8 billion through public and private investment to promote institutional reforms and development in the Northern Triangle,” a term that refers to Honduras, Guatemala and El Salvador.

Lopez Obrador’s administration has said it is also interested in agricultural, forestry and tourism projects in southern Mexico, and the U.S. said it will contribute to those efforts.

The U.S. Overseas Private Investment Corporation “is prepared to invest and mobilize $2 billion in additional funds for projects in southern Mexico that are viable and attract private sector investment,” according to the statement. “This amount is in addition to the $2.8 billion in projects for Mexico through OPIC’s current investment pipeline.”

Ebrard said “The commitments established here signify more than doubling foreign investment in southern Mexico starting in 2019.”

Southern states like Chiapas and Oaxaca are home to many of Mexico’s poorest communities. Lopez Obrador, who took office Dec. 1, has sought to make development in that region a priority, including plans for a “Mayan train” stretching from touristy parts of the Yucatan Peninsula down to Chiapas.

It was unclear if Mexico would give anything in return. A planned announcement about Mexico’s migration policy was postponed until Wednesday.

The United States has reportedly wanted Mexico to allow migrants seeking asylum in the United States to remain in Mexico while their applications are processed.

Ebrard had previously suggested that about $25 billion in U.S. investment would be an appropriate figure for what Mexicans and Central Americans have dubbed “The Alliance for Prosperity” in the region.

Judge: Broward Coward Had No Duty to Protect Students

A federal judge threw out a suit against Broward County ruling that there is no consitutional duty for the police to protect people.

The Sheriff's office (and Office Scot Peterson in particular) came under fire last year for the woefully inadequate response to the Parkland high school shooting last year. Instead of intervening, Peterson sought cover, and hid until more help arrived.

Apparently that was his Constitutional right.

U.S. District Judge Beth Bloom dismissed a suit filed by 15 students who claimed they were traumatized by the crisis in February. The suit named six defendants, including the Broward school district and the Broward Sheriff’s Office, as well as school deputy Scot Peterson and campus monitor Andrew Medina.

Bloom ruled that the two agencies had no constitutional duty to protect students who were not in custody.

“The claim arises from the actions of [shooter Nikolas] Cruz, a third party, and not a state actor,” she wrote in a ruling Dec. 12. “Thus, the critical question the Court analyzes is whether defendants had a constitutional duty to protect plaintiffs from the actions of Cruz.

“As previously stated, for such a duty to exist on the part of defendants, plaintiffs would have to be considered to be in custody” — for example, as prisoners or patients of a mental hospital, she wrote.
