NEW YORK (AP) — Donald Trump's company no longer prepares the sweeping financial statements that New York state contends were full of deceptive numbers for years, an executive testified Monday at the former president's civil fraud trial.

Trump's 2014 to 2021 “statements of financial condition” are at the heart of state Attorney General Letitia James' lawsuit against him, his company and some of its key figures. The defendants deny wrongdoing, but James says they misled lenders and insurers by giving them financial statements that greatly inflated Trump's asset values and overall net worth.

Nowadays, the Trump Organization continues to prepare various audits and other financial reports specific to some of its components, but “there is no roll-up financial statement of the company," said Mark Hawthorn, the chief operating officer of the Trump Organization’s hotel arm.

He wasn't asked why the comprehensive reports had ceased but said they are “not required by any lender, currently, or any constituency.”

Messages seeking comment on the matter were left with spokespeople for the Trump Organization.

Hawthorn was testifying for the defense, which argues that various companies under the Trump Organization’s umbrella have produced reams of financial documents “that no one had a problem with,” as lawyer Clifford Robert put it.

A lawyer for James' office, Andrew Amer, stressed that the suit is about Trump's statements of financial condition, calling the other documents “irrelevant.”

Now finishing its second month, the trial is putting a spotlight on the real estate empire that vaulted Trump into public life and eventually politics. The former president and current Republican 2024 front-runner maintains that James, a Democrat, is trying to damage his campaign.

Trump asserts that his wealth was understated, not overblown, on his financial statements. He also has stressed that the numbers came with disclaimers saying that they weren’t audited and that others might reach different conclusions about his financial position.

Judge Arthur Engoron, who will decide the verdict in the non-jury trial, has already ruled that Trump and other defendants engaged in fraud. The current proceeding is to decide remaining claims of conspiracy, insurance fraud and falsifying business records.

James wants the judge to impose over $300 million in penalties and to ban Trump from doing business in New York — and that’s on top of Engoron’s pretrial order that a receiver take control of some of Trump’s properties. An appeals court has frozen that order for now.

President Trump Releases Statement Regarding New York Judge    by Vince Quill1 day ago1 day ago

President Trump has released several statements regarding New York Judge Arthur Engoron.

Following an overturning of Engoron’s unconstitutional gag order and a temporary lifting of that order, the 45th President took to social media to lambast the clearly partisan judge.

Trump told his followers on Truth Social: “Judge Arthur Engoron has just been overturned (stayed!) by the New York State Appellate Division (Appeals Court), for the 4th TIME (on the same case!).

His Ridiculous and Unconstitutional Gag Order, not allowing me to defend myself against him and his politically biased and out-of-control, Trump-Hating Clerk, who is sinking him and his Court to new levels of LOW, is a disgrace.

They are defending the Worst and Least Respected Attorney General in the United States, Letitia James, who is a Worldwide disgrace, as is her illegal Witch Hunt against me.

The Radical and Unprecedented actions of Judge Engoron will keep BUSINESSES and JOBS forever out of New York State.

I have done NOTHING WRONG, my numbers were low, not high, I have a COMPLETE DISCLAIMER CLAUSE, their Star Witness admitted he lied and made up this Fake case against me, and the Attorney General used a “Get Trump” platform in order to run for A.G. & Governor (she failed!). This wicked attack on Democracy must be ended, NOW!”

Federal Judge Makes Huge Decision On Voting Machines In Georgia

by Anthony T   11 hours ago11 hours ago

A Federal judge in Georgia has ruled there is sufficient evidence that Georgia’s election machines are prone to cybersecurity issues.

U.S. District Court Judge Amy Totenberg wrote there is a cause to believe that “cybersecurity deficiencies that unconstitutionally burden Plaintiffs’ First and Fourteenth Amendment rights and capacity to case effective votes that are accurately counted.”

Judge Totenberg also shot down the idea that the plaintiffs in the case were “conspiracy theorists” for suggesting election machines are susceptible to being hacked.

She wrote, “The Court notes that the record evidence does not suggest that the Plaintiffs are conspiracy theorists of any variety. Indeed, some of the nation’s leading cybersecurity experts and computer scientists have provided testimony and affidavits on behalf of the Plaintiff’s case in the long course of this litigation.”

Per The Post Millenial:

A federal judge in Georgia has set a trial date for the case on whether the state’s voting machines are prone to cybersecurity issues. The plaintiffs argue that the machines could impact voters’ ability to effectively cast their ballots. This would be in violation of the United States Constitution.

US District Court Judge Amy Totenberg set the bench trial date for Jan. 9, 2024. The lawsuit was filed by the Coalition for Good Governance, which is an election integrity advocacy group, and several individual voters. The plaintiffs are requesting the use of hand-marked paper ballots in place of electronic voting machines on grounds that the machines, which are made by Dominion, are susceptible to cybersecurity issues, according to Newsmax.

The plaintiffs hoped to come up with a resolution without the need for a trial, but Judge Totenberg issued a ruling on Friday and said: “The Court cannot wave a magic wand, in this case, to address the varied challenges to our democracy and election system in recent years, including those presented in this case. But reasonable, timely discussion and compromise in this case, coupled with prompt, informed legislative action, might certainly make a difference that benefits the parties and the public.”

Georgia Secretary of State Brad Raffensperger and members of the State Election Board are named as defendants in the suit.

The lawsuit included an expert report that detected weaknesses in the Georgia election system. As a result, a federal cybersecurity agency issued an advisory to jurisdictions utilizing the equipment. Furthermore, the report prompted certain Georgia Republicans to advocate for the abandonment of the voting machines altogether.

Per Becker News:

Judge Amy Totenberg has issued a decision concurring there is sufficient reason to believe that the electronic voting machines used by the State of Georgia have substantial flaws.

The District Court Judge found that there is sufficient cause to believe that there may be “cybersecurity deficiencies that unconstitutionally burden Plaintiffs’ First and Fourteenth Amendment rights and capacity to case effective votes that are accurately counted.”

Totenberg scheduled a bench trial for January 9, 2024, which entails the absence of a jury. Nevertheless, she acknowledged that a compromise might be possible if the state legislature were to take action.

“The Court cannot wave a magic wand in this case to address the varied challenges to our democracy and election system in recent years, including those presented in this case,” she wrote. “But reasonable, timely discussion and compromise in this case, coupled with prompt, informed legislative action, might certainly make a difference that benefits the parties and the public.”

Critically, the court denied that criticism of security flaws with Georgia’s voting machines are based purely on “conspiracy theories.”

Historical ruling by Judge! Anyone questioning elections or election machines are not conspiracy theorist!

Biden Administration's $10 Billion Prize to Iran: Just A Small Thank You for Engineering a War, Wounding 56 US Troops and Trying to Drive the US Out of The Middle East.

·by

The solution is not to give Iran $10 billion as a prize for practicing extensive regional aggression and engineering mass-murder. Real solutions would include cutting the flow of funds by re-imposing -- and enforcing -- primary and secondary sanctions; incapacitating the port from which Iran sends oil to China; sending Ayatollah Khamenei and the leaders of the Islamic Revolutionary Guard Corps (IRCG) pictures of their homes; making the ruling mullahs seriously aware of military options, such as taking out the training bases and leadership of the IRGC, and employing significant military force when required -- for instance now.

A little late with this post, but at least we can know the GOP is doing SOMETHING!! (from Nov. 1st)

Jim Jordan Announces Investigation Into DOJ For Alleged Spying On Congressional Staffers November 1, 2023  Martin Walsh  Conservative Brief

Ohio Republican Rep. Jim Jordan announced that the House Judiciary Committee has begun looking into reports that the Justice Department spied on members of Congress and their staff.

Iowa GOP Sen. Chuck Grassley is also looking into allegations that the Department of Justice spied on his former chief investigative counsel, Jason Foster. On Tuesday, Jordan made the investigation public on Fox Business.

“We now know that they spied on congressional staffers,” Jordan said in an appearance on Fox Business’s The Evening Edit with Elizabeth MacDonald. “We want to know, how far does it go? Were they spying on members? Were they spying on other staffers? Keep this in mind, Liz: We know they spied on President Trump’s campaign. We know all that from the FISA Court and what they did with Carter Page and Papadopoulos—everything else. Now we’ve learned that they spied on one of Sen. Grassley’s staff members, Jason Foster.”

“We want to know, does it go further?” he stressed. “So we’ve sent letters not only to the Department of Justice but to all these carriers that the Department of Justice worked with to get the phone records and the email records from congressional staffers like Mr. Foster. How far does this go? Were they spying on members and other staff?”

Jordan wrote to Alphabet, Apple, AT&T, T-Mobile, and Verizon’s CEOs, as well as Attorney General Merrick Garland, requesting information about the DOJ’s alleged attempts to obtain the private communications of members of Congress and their staff as part of the investigation.

“The Justice Department’s efforts to obtain the private communications of congressional staffers, including staffers conducting oversight of the Department, are wholly unacceptable and offend fundamental separation of powers principles as well as Congress’s constitutional authority to conduct oversight of the Department,” the letter to Apple CEO Tim Cook read.

The letter continues by elaborating on the claim that the DOJ issued subpoenas to congressional staffers looking into the DOJ’s Crossfire Hurricane operation on behalf of the House Permanent Select Committee on Intelligence in order to obtain emails and records.

“These revelations strongly suggest that the Justice Department weaponized its law-enforcement authority to spy on the entities seeking to hold it accountable,” the letter stated.

Jordan Lays Out Timeline For Biden Impeachment Inquiry     November 13, 2023  Jon Dougherty  Conservative Brief

House Judiciary Committee Chairman Jim Jordan has laid out a timeline for when the GOP-controlled House will make a decision on whether to move forward with an official impeachment of President Joe Biden.

On Sunday, the Ohio Republican said a decision on whether to proceed will most likely be made shortly after the first of the year, according to Newsweek.

“The House Oversight Committee is currently conducting an inquiry into the Biden family after then-House Speaker Kevin McCarthy, a Republican from California, announced the investigation in early September,” the outlet reported on Sunday.

“At the center of the Biden impeachment inquiry is his alleged involvement in his son Hunter Biden’s foreign business dealings. The White House has repeatedly denied that the president ever had any involvement in his son’s business,” the outlet continued.

Last week, Oversight Committee Chairman James Comer (R-Ky.) signed subpoenas for first son Hunter Biden and the president’s brother, James Biden, along with additional members of their family. Also, Comer signed off on a subpoena for Rob Walker, who is a former business associate of Hunter.

The first son has been requested to appear for a closed-door deposition on Dec. 13, while James Biden “is expected to attend a deposition on December 6 and Walker is scheduled for November 29,” Newsweek reported.

Jordan, who is also a member of the Oversight Committee, revealed to Fox News host Maria Bartiromo on Sunday how he sees the impeachment timeline playing out.

Trump Posts Photo Of Paper He Attempted To Show Judge In Civil Fraud Trial

November 9, 2023  Jon Dougherty  Cnservative Brief

Former President Donald Trump shared a document on his Truth Social page stating that the Manhattan judge presiding over his civil fraud trial refused to allow him to appear in court.

In the post, Trump said he pulled the document from his jacket pocket during sometimes raucous testimony on Monday but was denied permission to read it. Trump identified the document as a disclaimer, which he then claimed vindicated him in the $250 million civil fraud case that New York Attorney General Letitia James had brought against him.

“This is the Paper that I wanted to submit that the Judge refused to take, because he doesn’t want anybody to know about the Disclaimer Clause at the beginning of each Financial Statement,” Trump wrote in his social media post.

Attached to the post was a document titled “Disclaimers Provided to Banks in Each Financial Statement.” The document instructs the reader that “considerable judgment is necessary to interpret market data and develop the related estimates of current value.”

“Users of this financial statement should recognize that they might reach different conclusions about the financial condition of Donald J. Trump,” the document concludes.

Judge in Trump Case Suddenly in Trouble – New Accusation Shakes Up Donald’s Trial
By Mick Farthing|  November 9, 2023

From the very start of the New York civil trial against Donald Trump, many were skeptical. The judge presiding over the case, Arthur Engoron, has been accused of having an anti-Trump bias.

Recently, he refused to let Trump read a disclaimer from his banking records that might have destroyed the prosecution’s case. Previously, he sparked outrage when he smugly smiled at reporters’ cameras.

Now, one right-wing activist is blowing the whistle on a possible connection to Judge Engoron. If true, Trump’s team might move for a mistrial
.

From The Post Millennial:
Screenshots obtained by investigative journalist Laura Loomer showed that Mrs. Engoron created, liked, and shared a number of anti-Trump posts, many of which were directly related to the trial.

One post included an AI-generated image of Trump bald in an orange prison jumpsuit next to one of an old lady scrawling “F*ck Trump” on a brick wall. Another was simply the latter.

Posts have emerged that suggest the wife of Judge Engoron has posted a variety of anti-Trump images to X. Some of them include AI images of Trump in prison, while others contain expletives against the former president.

Many Trump supporters have expressed doubts that Judge Engoron will rule fairly. Trump has repeatedly accused Engoron of having a bias against him. Considering the case is being held in blue New York, many will agree with Trump.

These posts could prove that Engoron holds a strong bias against the defendant. Should Americans believe whatever ruling he gives is fair, if his wife really is behind these posts?

According to Newsweek, a liberal website, Engoron’s wife denied making the posts.

From Newsweek:
Judge Arthur Engoron’s wife, Dawn Engoron, denied making social media posts attacking former President Donald Trump in a statement to Newsweek…

“I do not have a Twitter account. This is not me. I have not posted any anti Trump messages,” she said.

It is common for public figures to claim social media posts are not theirs, sometimes claiming their accounts have been hacked. It is unclear if Engoron is backtracking or if her statement is factual.

Regardless, this development will give Trump supporters more reason to distrust this trial. And Trump’s lawyers might have grounds to demand it be thrown out.

DOJ Declined Special Counsel Request to Prosecute Hunter Biden in 2022  Updated: 1 day ago

The U.S. attorney for Delaware, however, insisted in his voluntary testimony before the House Judiciary Committee earlier this week that he had finally obtained the authority to bring charges against the 53-year-old first son in California and Washington, DC – jurisdictions that refused to partner with Weiss – should he “choose to do so.”

Good Word News

Throughout his testimony, which occurred behind closed doors and was the product of negotiations between congressional and Justice Department officials, Weiss said he could not answer numerous questions about decisions made over the course of the years-long probe into the president's son, citing federal norms that prevent prosecutors from speaking about investigations before they are completed.
CBS News

Special counsel David Weiss sought Justice Department authority in February 2022 to give him the power to prosecute Hunter Biden outside his jurisdiction, but DOJ officials were unwilling to do so right away, the Washington Examiner reported. Word of Weiss' request came in a transcript of the now-special counsels' closed-door testimony before the House Judiciary Committee.

Kamala’s Surprising New Secret Just Leaked – The VP’s Gaza Connection Stuns Americans
By Mick Farthing|November 6, 2023
The official stance of the Biden administration is to support the nation of Israel. As Israel wages its war against Hamas, the United States has pledged military aid, among other forms of help.

That has upset many Democrats, who are siding with pro-Palestinian, anti-Israel groups.

Biden has offered aid to citizens of Gaza. But it looks like someone close to Vice President Harris intends to do much more.

From New York Post:
The stepdaughter of Vice President Kamala Harris is publicly raising money for Gaza…

Ella Emhoff, 24 — whose father, first gentleman Doug Emhoff, is Jewish — affixed a fundraising drive “supporting urgent relief for Gaza’s children” on her personal Instagram account…

The fundraiser, which has netted more than $7.8 million so far, is being operated by the Palestinian Children’s Relief Fund, a nonprofit based in Kent, Ohio, which raked in more than $21 million in 2021, according to ProPublica.

Kamala Harris’s stepdaughter is supporting a fundraiser to help Gaza residents. The drive has brought in a reported $8 million. It is being run by a group called “Palestinian Children’s Relief Fund.”

Critics have already slammed Harris’s family over the news. Rep. Van Drew, member of the House Homeland Security Committee, said “it was almost certain” that the money will be used by Hamas.

It has been documented how Hamas takes much of the money meant for Gaza citizens. The money is never used to provide humanitarian aid. Instead, Hamas uses it to construct missiles and other weapons used on Israel.

Others have questioned Emhoff’s alliances. Despite her father being Jewish, she has said she does not consider herself Jewish. Even her representative once said, “Ella is not Jewish.” It’s unclear why the vice president’s daughter appears to be hostile toward Israel.

But many young liberals are siding with Palestine, accusing Israel of being an “apartheid state.” Many college students have signed letters condemning Israel and its response to the October 7 attacks. Some have even claimed Israel has lied about the attacks, faking footage.

President Biden has vowed $100 million in “humanitarian assistance” for residents of Gaza. But many have claimed this money will end up helping Hamas, not civilians.

Appeal, Appeal, Appeal !!! To the Supreme Court !!!

Trump Pulls Out Paper from His Suit During Testimony, Says It Completely Vindicates Him   The Western Journal  Story by Joe Saunders  • 5h

Eduardo Munoz - Pool / Getty Images© The Western Journal

It was a show-stopper moment in the political show trial of former President Donald Trump

On the witness stand on Monday in his civil fraud trial in Manhattan, the former New York real estate king and leading 2024 GOP presidential candidate drew a piece of paper from his jacket pocket that he said would end the case once and for all.

Naturally, he wasn't allowed to read it.

According to the New York Post, the document was likely a disclaimer notice, a kind that's routine in major financial transactions, that warned potential lenders to the Trump Organization that they needed to conduct their own valuations of Trump properties before deciding to lend the business money.

A $250 million civil suit brought by New York's politically ambitious Attorney General Letitia James accuses Trump and his business of overvaluing the Trump Organization's assets in order to borrow money on more favorable terms.

Setting aside the absurdity of a lawsuit that doesn't even make a claim that any person or entity was victimized -- all loans were repaid at the agreed-upon interest.

It's simply ludicrous to believe that the sharp-eyed money men (and women) of Manhattan's financial scene were so wet behind the ears that they would lend 10 cents, much less tens of millions of dollars, based solely on the word of the borrower.

It's even worse to pretend that a state attorney general in a fiscal disaster like New York -- a state that's bleeding population and battered by budget problems \-- is going to do a better job watching out for private bank money than the extremely highly paid bank managers are going to do.

But James campaigned on a promise of getting Trump, and she's keeping that promise -- no matter what damage it does to the concept of justice under the law in New York.

She's being abetted in the vendetta by New York Supreme Court Justice Arthur Engoron, who has made his disdain for the defendant abundantly clear throughout the proceedings (it's an opinon Trump clearly returns in spades).

In fact, as Reuters reported in September, Engoron has already ruled on the heart of the case -- finding that Trump and his organization are guilty of fraud. What's being argued now boils down to the penalties.

So, naturally, Engoron had no use for Trump's reading the disclaimer document.

"I would love to read this, Your Honor, if I could?” Trump said, according to the Post.

“Not at this point, not at this point,” Engoron replied.

"I'm shocked," Trump answered.

The dispute over the document eventually set off a witness stand eruption by the 45th president.

"He called me a fraud and he didn’t know anything about me!” Trump shouted, pointing at Engoron, according to the Post.

He then included James in his denunciation.

“The fraud is on the court and not on me … the fraud is on her!” he said, the Post reported.

Courtroom outbursts are rarely justified, of course, but if ever one was, it was this one.

Judges have no legal authority to bar Trump from 2024 ballots

Story by Hans von Spakovsky  • 5h   Washington Examiner

As state court proceedings get under way in Colorado, Michigan and Minnesota in lawsuits aimed at barring Donald Trump from appearing as a presidential candidate on the ballot in next year’s presidential election, the judges in those cases should understand that the text, history, and application of the 14th Amendment make it clear that they have no legal authority to take any such action.

Due to Trump’s supposed actions on Jan. 6, 2021, the challengers are trying to argue that Section 3 of the 14th Amendment, the disqualification clause, prevents him from being president even if he is elected, so he should be removed from the ballot by state election officials.

Section 3 provides that:
No person shall be a Senator or Representative in Congress, or elector for President and Vice President, or hold any office, civil or military, under the United States … who, having previously taken an oath, as a member of Congress, or as an officer of the United States … to support the Constitution of the United States, shall have engaged in insurrection or rebellion against the same … . But Congress may, by a vote of two-thirds of each House, remove such disability.

Because Trump allegedly engaged in an insurrection, according to the challengers, he is disqualified by Section 3.

There are three major legal problems with that claim, however.

First of all, Section 3 only applies to individuals who were previously a “member of Congress,” an “officer of the United States,” or a state official. Trump has never been any of those. He has never held state office or been a U.S. senator or representative, and the U.S. Supreme Court held in 1888 in U.S. v. Mouat that “officers” are only those individuals who are appointed to positions within the federal government.

Individuals who are elected—such as the president and vice president—are not officers within the meaning of Section 3. The Supreme Court reiterated that view in 2010 in Free Enterprise Fund v. Public Company Accounting Oversight Board, in which Chief Justice John Roberts concluded “the people do not vote for ‘Officers of the United States.’” They are appointed under Article II of the Constitution.

Is this warning to the Ukraine or to the USA???

Russian Official Issues Nuclear Weapons Warning After Historic Achievement

Story by Nick Mordowanec • 8h  NEWSWEEK

A high-ranking Russian official is touting his nation's nuclear arsenal as the world's best.

Nikolai Patrushev, secretary of Russia's Security Council, said during a recent appearance at the Znanie (Knowledge) education expo in Moscow that his nation for the first time has surpassed all other countries in terms of nuclear proficiency.

Patrushev, former director of the Federal Security Service and a close confidant of Russian President Vladimir Putin since the 1970s, has been rumored to be a possible successor to Putin. Patrushev worked with Putin at the KGB and has been steadfast in supporting Russia's war in Ukraine since the February 2022 invasion.

"For the first time in the history of the existence of nuclear missile weapons, our country is ahead of its competitors in this [nuclear] domain," Patrushev said at the Znanie expo, according to the state-owned RT television channel.

He reportedly alluded to his country's "unique strategic weapons, including hypersonic ones," predicting that this "will guarantee Russia's security for many decades."

Newsweek reached out to the Russian Defense Ministry via email for comment.
