Paul Fights Back Against Obama’s Gun Ban for Social Security Recipients    by - One of Barack Obama’s executive edicts issued in July of last year would in effect ban many seniors from gun ownership based on findings of the Social Security Administration.Any senior who was labeled as having “mental health issues” by the SSA would be stuck on Obama’s national gun ban list and be denied their 2nd Amendment Rights.Obama’s edict was so broad that even seniors who merely asked to have their finances overseen by a relative would be banned from buying guns.Paul’s legislation–Protecting Gun Rights and Due Process Act–explicitly “prevents the Social Security Administrator from reporting individuals to NICS unless [that] individual has been adjudicated as mentally incompetent.”In other words, it makes a finding of mental incompetence the result of a process rather than a proclamation. This protects the due process rights of each individual who might otherwise have simply been proclaimed mentally incompetent.Moreover, even after the proper process has been followed, Paul’s bill requires the Attorney General to certify each adjudication–which is one more way of taking pains to ensure the protection of individual rights. And once an adjudication is lifted or absolved, rights are restored to the individual.

The question now is: will Congress challenge the President’s ham-handed senior gun ban in the run up to the 2016 elections.
